Isn't that what has happened with Michael Schiavo? Let's assume he has been engaged in an adulterous affair for years, as has been reported. Have he and Terri been divorced? No. Has he been an unfaithful husband? That seems to be the case. But he is still legally, covenantally Terri's husband.
Therefore, I see no grounds for the argument that he has abandoned his rights as a husband, due to his adultery, and therefore Terri's parents should be making the decision. I would think that legally, covenantally, he still is her husband, and he has the legal right to make decisions for her when she is incapacitated.
Now, that is not to say that he has the right to starve her to death, nor is it to deny that the state could find grounds for spousal abuse and place her in protective custody. But one line of argument I have heard involves his adultery, and I just don't see that as a valid argument.
